§ 9405.2. Determination, Invoicing, and Hearing.
A.
The Development Services Department shall maintain records of all enforcement and abatement costs and prepare an itemized invoice. Unless otherwise ordered or determined by a court of competent jurisdiction, Code Services staff shall give notice by certified mail of the costs of abatement to the owner and any responsible person. The notice shall contain an itemized invoice of the costs and shall include a statement that the owner and any responsible person may request a hearing with the Director in writing within 10 days of the date of the notice. The Director may designate a third party hearing officer to hold the hearing.

If a hearing is requested, the Director or his or her designee shall set a date for the hearing and cause notice of the hearing to be sent by certified mail to the owner and any responsible person at least ten (10) days before the date of the scheduled hearing. After the hearing, the Director may confirm, revise, correct, or modify the amount of the costs. The Director shall give notice of the decision on the assessment of the costs, which shall be delivered by certified mail to the owner and any responsible party. The decision of the Director shall be final. Any appeal of the Director's decision shall be governed by California Code of Civil Procedure section 1094.6, or as may be amended from time to time.
